General Terms and Conditions

Effective date: 1st January 2017

These General Terms and Conditions (hereinafter: the “Terms and Conditions”) specify the terms and conditions of using the website exclusively owned by HUNTELS LTD (UTR No. 53631 24560, Company Number 9557166 given at Companies House, Cardiff, on 23rd April 2015 the Registrar of Companies for England and Wales, certifies that HUNTELS LTD is incorporated under the Companies Act 2006 as a private company, that the company is limited by shares, and the situation of its registered office is in England and Wales: 20-22 Wenlock Road London N1 7GU England., hereinafter: “HUNTELS LTD”, or the “Provider”), named (www.huntels.com), named by HUNTELS LTD. (hereinafter: the “Website”).   

Every natural or legal person of legal age or unincorporated business association or other organisation that browses, uses the Website and/or initiates purchases through it qualify as a user (hereinafter: the “User”). By using the Website, purchasing through it, signing up for a newsletter the User accepts these Terms and Conditions as binding.  Acceptance of the Terms and Conditions this way also means that the User accepts an obligation to track the changes of these Terms and Conditions. The language of the contracts concluded by accepting the Terms and Conditions is English, the contracts do not qualify as written contracts, and for this reason, the Provider does not file data, the data cannot be accessed later. All information concerning the website and its services (e.g.: prize games regulation) and other documents that can be linked from this document (e.g. Data Protection Regulation, Cookies Policy) are parts of the Terms and Conditions and are mandatory for every user. For the services of any website other than www.huntels.com (facebook.com, instagram.com, Google, websites owned by the sales partners of HUNTELS LTD) related to www.huntels.com the regulations, terms and conditions of the website in question (also) apply. Minors are not allowed to use the Website. If the User does not accept these Terms and Conditions, the User is not entitled to use the Website or to use the services offered by the Website.  

The owner and/or operator of the Website is entitled to unilaterally amend these Terms and Conditions at any time. The effective date of the amended Terms and Conditions is the day on which the amended Terms and Conditions are published on the Website. After the amendment the User accepts the amendment of the Terms and Conditions by using any part of the Service. 


1. Operational principles of the Website

The Website sells accommodation deals as an intermediary. The price of the given deal (‘Price’) is always given based on the list price provided by the place of accommodation. The deals sometimes can be purchased on discount. The place of accommodation is responsible for the accuracy of this information. The Provider reserves the right to change or even terminate any part of the Website.

Operation of the Service qualifies as an intermediary service based on The Electronic Commerce (EC Directive) Regulations 2002  and the Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of  information society services, in particular electronic commerce, in the Internal Market (Directive on electronic commerce). The Provider is entitled, but not obliged to check the content published or made accessible by the Users and Partners by using the Service, and the Provider is entitled, but not obliged to look for signs of illegal activities in respect of information published using the Service. As a mediated service the Provider sells the services (hereinafter: ‘Service or Huntels Deal’) of the partners in a contractual partnership with the Provider (hereinafter: ‘Partner’). In this respect only the User can qualify as a buyer. The Provider regularly publishes such deals on the Website.

HUNTELS LTD does not accept responsibility for possible mistakes (including publishing and electronic printing mistakes), outages (be it any (temporary and/or partial) failure, repair, upgrade or maintenance of our website or any of our services), inaccurate, misleading, or false data, or the deficient publishing of information. The places of accommodation are responsible at all times for the accuracy, completeness and validity of (descriptive) information published on the website (including prices and rooms). Our Website is not responsible for the deal and advertisement of the quality, service level and ranking of any of the published places of accommodation, and does not consider the same as parts of it. The services of HUNTELS LTD can only be used for personal, non-commercial purposes. Accordingly, resale, deep-linking, use, copying, observing (e.g.: spider, scrape), indication, downloading or multiplying the contents, information, software on the Website for any commercial or competitive purpose is forbidden. If the user purchases the Service, the Deal becomes active and the Users buying the Service receive their Huntels Codes (hereinafter: “Huntels Codes”) The “Huntels Code for reservation” is to be given by the user to the Partner during the reservation process for identification, and the “Huntels Code at check in” is to be given in the course of checking in at the reception desk to use the service in the deal.


2. Using the Website

2.1. Signing up for the newsletter without registration

The newsletter of HUNTELS LTD can be signed up for even without registration by clicking on the button “Subscribe” after giving the subscriber's last name, first name and e-mail address. Following this the person will receive notifications about the newer Deals of HUNTELS LTD by e-mail. The newsletter can be unsubscribed from at any time. Registration is necessary to use the services specified in the Deals.

2.2. Registration

2.2.1. Direct registration:

By clicking on the “Registration” button on the website the user give the current information: first name, last name, contact phone number, e-mail address, password, country, ZIP code, city, street. After this, the User is immediately entitled to use all the services of the Website.

By registering on the Website in any way the User gives his/her consent to the operator of the Website sending newsletters, offers, notifications concerning the Website for him/her to the e-mail address provided at the time of registration.

The User acknowledges and consents to the Provider asking for his/her first name, last name, contact phone number, e-mail address, password, country, ZIP code, city, street when registering. The Provider can only use personal data for its own purposes, in accordance with the data protection regulation, and can only give them to third parties if obliged to do so by legal regulations or authorities.  

2.3. Using the Website

2.3.1. Buying a Huntels Deal

The service prices given in the deal are always gross prices to be actually paid by the User, in EUR. Only registered users can buy the deals, following the steps below.  

For the majority of the deals several options are available (e.g. deal for two nights, deal for 3 nights). After selecting the desired option the buyer can give the number of items as well, and put them in the basket by clicking “BUY!”.  If the user wishes to buy several options within the same deal, then this procedure is to be performed consequently. Several deals can also be bought, in this case you can return to the deals on the page by clicking “Continue shopping” in the pop-up basket preview.  After finishing the shopping you can start the ordering process by clicking “Go to basket” or “Checkout” at the basket data on the top of the website.

In the “Enter Data” item the buyer can check their personal data, select invoice and mail address (provided earlier during registration) or can modify such data if necessary.  

Payment method can be selected in the Payment method menu item.  

After selecting payment method the buyer can review the content of the basket and the final amount in the “Order summary” menu item and can make comments on the purchase in the “Comment box”.

To finish the shopping process the user must read the “Terms and Conditions” and accept its provisions; the order can be sent afterwards by clicking “Place your order”.

Presently you can select from two payment methods on the site: paying with bank card or standard bank transfer. Both options are entirely safe: no card information is disclosed, nor will Huntels LTD receive it.

CURRENTLY NOT AVAILABLE: Shopping with bank card.

The user can initiate the standard bank transfer on the internet interface of their own bank or personally in a branch office of the bank by giving the data of  HUNTELS LTD and indicating the unique ID of the order (Order ID) in the Notes section. The user receives confirmation about their order when registering, also recorded in their user account (Earlier order). The order of user gets to “Waiting for approval” status. Within 3 working days at the most after the purchase price arrives and is identified the status of the order is changed by HUNTELS LTD to “Accepted” and the user is notified about this in email. The email notifying the user about the status change (in the “Comment box”) contains all information necessary to use the service.  

If the user indicates the unique order ID (Order ID) necessary for their identification in the notes section in a faulty manner or not the appropriate amount is transferred, then the HUNTELS LTD cannot identify the amount that arrived to its account. In this case the user is obliged to indicate not getting confirmation about their order and the information necessary for using the deal in a letter sent to the email address of the customer service of HUNTELS LTD (help@huntels.com).  

2.3.2. Redeeming coupons/vouchers bought at the Sales Partners of HUNTELS LTD

The User can redeem coupons/vouchers bought at the Sales Partners of HUNTELS LTD (hereinafter: “Sales Partners”) and paid for to them on the website. To do this, the User has to follow the instructions in the redeeming information on the website of the Sales Partner, and fill in a form on the Website. The User has to provide their name, a valid email address, the name of the accomodation, where did the user bought the voucher or coupon (the name of the Sales Partner), their voucher/coupon code(s) and indicate the number of items and click Continue! The User can leave a message to HUNTELS LTD int he comment box, If they want.   

If the user purchased several deals, the user has to complete several forms. When the user complete the form, they can redeem voucher/coupon code to one deal, but can indicate the number of the option (most deals have several options, e.g. deal for two nights, deal for 3 nights).

After checking the provided voucher/coupon codes, within 3 working days at the latest, HUNTELS LTD informs the user about the success of the exchange by email, and the email shall contain all information necessary to use the service.

When the user complete the form it is important to provide a valid e-mail address that the user check daily, because the Huntels Ltd will send all information necessary to the provided email address.

If the provided voucher/coupon codes are not valid or other information is not correct, HUNTELS LTD inform the user about it and help the user to provide the correct information.

2.3.3. Other provisions concerning the use of the Website

The User is obliged to act according to the requirements of good faith and fairness when using the Website. Consequently, the User cannot use the site to distribute unlawful content, computer viruses or unauthorised data collection.  

The User is especially responsible towards HUNTELS LTD for all such damage suffered by HUNTELS LTD, the Provider that was caused by the User using the Website in an illegal and/or unintended way.

Without the prior written consent of HUNTELS LTD the user is not entitled to use the Website or its contents (images, texts, descriptions) for advertisement or other promotional purposes, and using the same for political purposes is strictly forbidden. 

Furthermore, the User acknowledges that his/her customs related to using the Website ca be collected for statistical purposes in a way not appropriate for personal identification. The User further acknowledges that the Provider supervises and moderates interactive interfaces available on the Website.

The User is obliged to keep his/her password related to his/her registration secret and to take any necessary and reasonable measure so that unauthorised persons cannot access the User’s account.


3. The Huntels Codes and their use

The Service Provider is the assigned distributor of the services of the site of accommodation indicated in the deal, performs its task as a mediator, and so excludes all responsibility if the services of the accommodation site fail for any purpose. The person/user buying the deal acknowledges that it can only and directly enforce their repayment or compensation claims towards the site of accommodation indicated in the deal. The responsibility of HUNTELS LTD only extends to paying the consideration for the deal to the site of accommodation. The service relationship is established between the site of accommodation indicated in the deal and the person buying the deal. 

If the user successfully completed the shopping process and their payment arrived on the account of HUNTELS LTD, then within 3 working days at the most HUNTELS LTD changes the status of the order of the user to “Accepted” and the user is notified about this in email. The email notifying the user about the status change (in the “Comment box”) contains all information necessary for reservation:

•           the User’s unique „Huntels Code for reservation”

•           the User’s unique „Huntels Code at check in”

•           Huntels Deal details (link)

•           contact information of the hotel/guesthouse/apartment

The user will find this information in their user account as well (“Earlier order”)

After this, the user must contact the site of accommodation through the provided contact options, indicate that they bought a Huntels Deal then give the “Huntels Code for reservation” unique ID and coordinate the further details of the reservation (meals, day of departure, contact information, etc.).

When the user arrives, they give the “Huntels Code at check in” unique ID at the reception desk when checking in. 

The site of accommodation issues the invoice about the used service for the user/buyer according to the effective legal regulations.


 

If the user successfully completed the voucher/coupon redemption process (filled in a form), within 3 working days at the most after checking the codes HUNTELS LTD send the user an email which will contain all information necessary for reservation:

  • the User’s unique „Huntels Code for reservation”
  • the User’s unique „Huntels Code at check in”
  • Huntels Deal details (link)
  • contact information of the hotel/guesthouse/apartment

After this, the user must contact the site of accommodation through the provided contact options, indicate that they have Huntels Codes then give the “Huntels Code for reservation” unique ID and coordinate the further details of the reservation (meals, day of departure, contact information, etc.).

When the user arrives, they give the “Huntels Code at check in” unique ID at the reception desk when checking in. 

The site of accommodation issues the invoice about the used service for the user/buyer according to the effective legal regulations.


4. Intellectual property

The Website and all the content, description, graphics, illustrations on the Website are the exclusive property of the Provider and its Partners if that is the case. The Website qualifies as a collection within the meaning of Copyright, Designs and Patents Act 1988. and as such, it is under copyright protection.   

It is forbidden to make copies of the content on the Website in any form, record it either in an analogue or in a digital way, recreate it, distribute it, forward it, download it, edit it, resell it or disclose it. Using any content of the Website in any form, for either commercial or other purposes, is only possible with the previous written consent of the Provider. Using the Huntels logo in accordance with these Terms and Conditions is possible even without a special written permit.

Any violation of the intellectual property of the Provider (trade mark infringement, violation of copyright, etc.) will result in the prosecution of the person violating the rights.


5. Limiting responsibility

Considering that the Provider sells services mediated on the Website within the framework of electronic trade, the Provider is not responsible for the quality of Services specified by its Partners. If, in the course of using the Service, the User suffers any loss, the Provider excludes any responsibility in respect of this. The User can only turn to the Partner with his/her damage claims.  

The Provider does not accept responsibility for the continuous, flawless operation of the Website and the related other websites, or for its being free of viruses and other malware. The Provider is not responsible for the possible loss of data forwarded by the User on the internet when using the Website.  The User is responsible for the sufficient condition of his/her own hardware and software devices and for the same being sufficient enough for using the internet and the Website, and for up- and downloading content to and from the Internet.

The Provider prepares the description of the Services by publishing the information provided by its Partners in full, without making any changes, so if there are any discrepancies between the described and the actual Service, responsibility for any losses originating from it is the burden of the Partner only.


6. Data processing

Confidential management of the personal data of the User is a priority requirement; for this reason the Provider does not disclose the personal data of the User to third parties, and only makes it accessible for the authorities within the limits of the relevant legal regulations.   

The Provider does not use the services of external data processors. The company itself processes the Personal data it manages.

From the personal data the User provided the Provider only uses the information necessary to identify the User so that the User can receive information about the different developments, services, the selection available on the Website, regularly expanded, and about the formal notifications of the Provider.

The data registered about the User by the data processor, the information stored in the databases maintained by the Provider can be used to settle the issues, disputes arising between the User and the Provider or between the User and the Partner.  

The Provider guarantees to manage the personal data of the Users respecting the effective legal regulations, in accordance with the provisions of the Data protection regulation. The Partner receives the names of the Users and the “Huntels Code for reservation” named unique identification number related to their purchased deals for the sole purpose of identifying the User and to avoid abuse.

7.
 Rescission

Based on the effective EU legal regulations on the detailed rules of contracts concluded by and between the consumer and the service provider the consumer is entitled to rescind from the contract without providing reasons within 14 days from purchasing the deal. In this case the User is obliged to notify the Provider in writing about his/her intention to rescind who is obliged to ask for a written confirmation from the Partner within 3 (three) working days from receiving the notification about that the Huntels Codes related to the Huntels Deal with indicated by the User have not been used yet, and to forbid accepting the Huntels Codes at the same time. If the Partner confirms it in writing that the Huntels Codes in question have not been used yet, the Provider immediately renders the Huntels Codes invalid, and are obliged to retransfer the purchase price of the Huntels Deal rendered invalid to the User within 30 (thirty) working days from receiving the notification of the Partner. The deal can be considered purchased when HUNTELS LTD confirms the order of the user and provides the Huntels Codes entitling the user for using the services specified in the deal.  The User acknowledges that if they start using the mediated service, in the case of rescission after this the User from the place of accommodation is entitled to conduct settlement related to the rescission. The date of starting to use the service is the date when the user contacts the place of accommodation and reserves a room for a given date or period and at the same time gives the “Huntels Code for reservation” code to the place of accommodation. At the time of the reservation the User accepts the effective reservation and rescission conditions of the place of accommodation about which the user can request information from the place of accommodation in question. Considering that HUNTELS LTD only promotes and sells the services of the place of accommodation as a mediator, and does not accept responsibility for damages due to rescission; however, it provides the opportunity to connect the place of accommodation and the User. If the statement of rescission or waiver of the User is received by HUNTELS LTD after the deadline specified herein, HUNTELS LTD forwards it to the place of accommodation.


8. Applicable law

The rules of the legal system effective in the area of the United Kingdom are to be applied to these Terms and Conditions. If any of the provisions of the Terms and Conditions would prove to be invalid it does not concern the validity of the other provisions, a provision complying with the legal regulations automatically replaces the invalid one.
